Progressives Should Embrace Article V as Path to Constitutional Flexibility

Dems Demand A Living Constitution: OK - Done!

Socialists Democrats often call for a living Constitution, arguing that the document should evolve to meet society’s changing needs. They believe this approach would allow the government to address modern challenges more effectively. Yet, they overlook a key fact: the U.S. Constitution already includes a built-in mechanism for change. This mechanism is Article V, which provides a clear, structured process for amending the Constitution.

The idea that the Constitution is rigid and unchangeable is a common misconception. Article V was designed specifically to allow the nation’s foundational document to adapt over time. It sets out two ways to propose amendments:

• Congressional Proposal: Amendments can be proposed if two-thirds of both the House of Representatives and the Senate agree.

• State Convention: If two-thirds of state legislatures (currently 34 states) request it, Congress must call a convention to propose amendments. (Convention of States Action is spearheading a movement to implement this option of Article V.)

Socialists Democrats want the Constitution to reflect current values and address issues like climate change, social justice, and economic inequality. Article V offers them a practical path to these goals by:

• Providing a Clear Process: Rather than relying on judicial interpretation or informal changes, Article V offers a transparent, democratic way to update the Constitution.

• Encouraging Consensus: The high thresholds for proposing and ratifying amendments ensure that changes have widespread support, which can help build lasting solutions.

• Maintaining Stability: While allowing for change, Article V protects the Constitution’s core principles by requiring careful consideration and agreement.

The Constitution has been amended 27 times, demonstrating that Article V works.

To embrace Article V, progressive socialists should:

• Educate Themselves and Others: Understanding the amendment process is crucial. This knowledge can empower activists to work within the system.

• Build Broad Coalitions: Since Article V requires wide agreement, forming alliances across political and social groups is essential.

• Focus on Clear, Achievable Goals: Proposing specific amendments that address pressing issues can gain more support than vague calls for change.

• Engage State Legislatures: Mobilizing state governments to request a convention or support amendments is a key step in the process.

Article V reflects the Founders’ foresight in allowing the nation to grow while preserving its legal foundation. By working within this framework, socialists Democrats can advance their vision without alienating those who value constitutional stability.
