NC Election Law Changes (H958 PCS): Email & Call Key Republican NC House Representatives

Your help is crucial to making necessary changes to the Election Law House Bill 958 PCS (Proposed Committee Substitute) before the 2026 midterms. 

  



The Good Parts: The bill bans Ranked Choice Voting, adjusts vote counting and absentee ballot management, authorizes the Auditor to convert 25 personnel positions into exempt status to permit new hires, requires voter ID with UOCAVA ballots, updates campaign finance reporting, and mandates the NC School of Government to assist in training curriculum development.

 

The Bad Parts: Two sections in the bill are of serious concern and need to be addressed to protect election integrity. They are:

  

  • Contributions by Foreign nationals in our elections;

     

  • Verification of Overseas Voters’ Addresses, Voter Registration, Voter Application, and Voter Verification.

Thank you for developing H958 to enhance our election system. However, I encourage you to consider additional important changes to the H958 PCS and to pass the bill with the NCEIT suggested modifications, addressing its deficiencies before the 2026 general election to rebuild voter confidence and strengthen election integrity. There should be no room for foreign influence in our elections. The addresses of overseas voters must be verified through available documents. Improving the voter registration application, registration process, voter qualifications, and the use of HAVA documents for address verification is recommended to enhance the accuracy of the voter registration list.

NCEIT TALKING POINTS for Revisions & Additions to H958 - PCS

 

  

  • There should be no exceptions to the definition of foreign nationals.

  

  • Foreign nationals should not be allowed to contribute money to N. C. elections.

  

  • National Chairman of the Election Transparency Initiative and former Virginia Attorney General Ken Cuccinelli issued the following statement:

 

We commend House Republicans for the improvements already made to H958; however, its section on foreign funding still falls short. Foreign billionaires and corporations should never be given the power—under any circumstances—to buy North Carolina’s elections and undermine voters so they can influence the state’s constitution. But the reality is that the bill, in its current form and without further amendments, will allow them to continue doing so easily.

Uniformed & Overseas Voter's Registration Address (IPCAVA): Uniformed & Overseas Citizens Absentee Voting Act (UOCAVA)

  

  • Thank you for proposing changes to UOCAVA voting, but there should be documentation of the voter’s address, such as a passport or driver’s license. When the address is unverifiable, the county BOE address should be used to register the voter.

 

  • Address verification is required for in-person and mail-in voting. UOCAVA voting should be treated the same.  

  

  • Over 60% of UOCAVA voters were civilians rather than military in 2024. That trend has been rising for years. (In 2024, 36% were uniformed military voters and 64% overseas civilian voters, according to the Election Assistance Commission.)

  • The voter registration application should include required, not requested, information so the voter can be verified. Full legal name and social security number help prevent duplicate registrations, especially with many hyphenated names. Driver’s licenses should be current and valid.

 

  •  There are millions of legal residents who are not citizens living in the US. Many of them have been improperly registered to vote. Requiring proof of citizenship for new registrations is an important step to improve accuracy and trust in the system.

 

  •  An application should not be approved until both identity and address verification are finished. Current law describes the address verification process, but the crucial step of identity verification is absent.

  • The law should emphasize that a person who is not a U.S. citizen will not be allowed to vote, which is consistent with a recent amendment to the NC Constitution.

  

  • The President’s Executive Order 14248 states that proof of citizenship is required to register to vote, so it should be considered a qualification. 

  

  • With the number of illegal immigrants in the country, we need to ensure that “only citizens vote.”

  •  HAVA documents should be used to verify address, not to verify identity.

  

  • HAVA documents are easily forged.

  

  • Current law requires efforts to obtain information to verify identity to occur during the registration process, not at the time of voting.

  

  • If voters lose confidence in the election system, they may be less inclined to vote, believing their vote will be canceled by ineligible voters.

  •  It is not a best practice to use HAVA documents for verifying identity. The BOE should contact the applicant to gather information, such as checking for errors in names and birthdates. 

  

  • Verifying identity is essential for a trustworthy voter registration database. It is a top priority in our country.
